1. NumberWorks’nWords Learn to Earn Program – Terms & Conditions General
1.1 NumberWorks’nWords customers who enrol for the first time must receive a receipt for their transaction. At the time of enrolment, NumberWorks’nWords customers will be required to select their nominated school. Transactions for NumberWorks’nWords customers will be recorded and a tally will be calculated on all receipts paid during the nominated period. At the expiry of the campaign. Money will be transferred to the nominated school’s tally without any further action required.
2. Participants
2.1 Primary and secondary schools in Australia that are government schools or registered as non-government schools under the Education Act in force in NSW can register to participate. NumberWorks’nWords retains absolute discretion whether to accept registration of a school in the Program (“Participant”). Unfortunately, NumberWorks’nWords cannot accept any registrations from home educators (whether registered or not), daycare centres or other pre/after school facilities, or kindergartens.
2.2 To participate in the Program, the school P&C Coordinator or Club Official or an authorised representative of the P&C Coordinator or Club Official must register as the program coordinator (“Coordinator”).
2.3 NumberWorks’nWords reserves the right to request proof of the Coordinator’s identity and appointment as Coordinator by the P&C Coordinator or Club Official. NumberWorks’nWords may suspend a Participant’s access to the program if this information is not provided within a reasonable period of time.
2.4 Any costs associated with participating in the Program, including any tax liability incurred by participation, is the responsibility of the Participant.
2.5 It is the responsibility of the Coordinator to ensure any permission required by the relevant authorities is obtained as a condition of entry in the Program.
3. Registration
3.1 The Coordinator must fully complete the registration process (“Registration”) to request to participate in the Program, and notify NumberWorks’nWords of any subsequent change in details.
3.2 If a school is unable to register online they may call NumberWorks’nWords.
3.3 Registrations are at the absolute discretion of NumberWorks’nWords. A Participant may elect at any time in writing to notify NumberWorks’nWords that it wishes to exit the Program, however the Participant will forfeit all rights to any receipts collected and will not be entitled to their percentage benefit.
3.4 Participants are required to enter a fixed physical postal address at the time of Registration. PO Boxes cannot be accepted as a postal address for the purpose of the campaign.
3.5 The Coordinator is responsible for ensuring that the correct fixed address has been provided. NumberWorks’nWords will not be liable for any incorrect information provided during Registration.
4. Receipt Collection
4.1 NumberWorks’nWords will collect receipts for sales during the nominated period.
4.2 NumberWorks’nWords may decide in its absolute discretion to amend the Campaign Period for the nominated period. If it decides to do so, NumberWorks’nWords will communicate the revised Campaign Period to Participants and will advise Coordinators of any revised dates for receipt counts and money delivery.
4.3 Receipts will be issued at NumberWorks’nWords centres. Receipts will be issued at the time of payment only.
4.4 The base offer is the issue of one receipt for every transaction spent in NumberWorks’nWords centres after any discounts have been applied to the transaction.
4.5 NumberWorks’nWords customers who pay online will not receive physical receipts at time of payment. Transactions for NumberWorks’nWords online customers will be recorded and a receipt tally will be calculated on all dollars earned.
4.6 NumberWorks’nWords customers must be enrolled in NumberWorks’nWords during the Campaign period as a new customer or enrolment to participate.
4.7 All benefits of the campaign must be provided to the nominated school, no benefit is to be provided directly to customers of NumberWorks’nWords centres.
4.8 A receipt collection box will be available in NumberWorks’nWords centres. NumberWorks’nWords is not responsible for any lost, stolen or damaged receipts and receipts will not be replaced.
5. Receipt Entry
5.1 In order to redeem receipts, Participants are required to place their receipts into the collection box provided within the participating NumberWorks’nWords centres by within the Campaign period. NumberWorks’nWords may accept receipts for enrolments paid after the Campaign Period at its sole discretion.
6. Receipts and School Payments
6.1 Upon receipt by NumberWorks’nWords of the receipts, the NumberWorks’nWords team will update the Schools’ account with the final dollar amount tally. NumberWorks’nWords count is final and no further correspondence will be entered into.
6.2 All receipts must be submitted by the Campaign End Date (“Final Order Date”), unless NumberWorks’nWords notifies Participants otherwise.
6.3 NumberWorks’nWords reserves the right to cap the number of enrolments available for redemption in the program across all Participants at any time.
7. Delivery of Payment
7.1 Payments to schools will be delivered to the physical address of the Participant.
7.2 NumberWorks’nWords will not be liable for failure to deliver the money due to incomplete or incorrect information provided by the Coordinator. Any costs associated with completing a misdirected delivery will be the responsibility of the Participant.
7.3 NumberWorks’nWords will not be liable for any disruption to the Program or any delay or inability to provide money caused by circumstances beyond the reasonable control of the NumberWorks'nWords Centre. If the Program is not capable of running as planned for any reason, including but not limited to technical malfunction, NumberWorks’nWords reserves the right in its absolute discretion to cancel, suspend or modify the Program. NumberWorks’nWords will use all reasonable endeavours to notify Participants of such cancellation, suspension or modification.
8. Refund policy
8.1 All benefits of the campaign must be provided to the nominated school; no benefit is to be provided directly to customers of NumberWorks’nWords centres.
9. Liability
9.1 Except as set out at clause 8.1, NumberWorks’nWords shall not be liable to Participants or any other person in connection with the Program or any Product obtained through it for any loss of any kind, damage, personal injury or death whether arising under contract, tort (including negligence) or otherwise, except any liability that cannot be excluded by law, in which case that liability will be limited to the minimum allowed by law.
10. Intellectual Property Rights and websites
10.1 The material contained on the Program Website is protected by copyright. Except to the extent permitted by relevant copyright legislation, you must not use, copy, modify, transmit, store, publish or distribute the material on the Program Website, or create any other material using material on the Program Website.
10.2 Trade marks (whether registered or unregistered) and logos used on the Program Website must not be used or modified in any way without obtaining the prior written consent of NumberWorks’nWords.
10.3 The Program Website and Products, technology and processes contained on them may be the subject of other intellectual property rights owned by NumberWorks’nWords or by third parties. No licence is granted in respect of those intellectual property rights other than as set out in these terms. Your use of the Program Website must not in any way infringe the intellectual property rights of any person.
11. Privacy Notice
11.1 NumberWorks’nWords treats compliance with the Privacy Act 1988 (Act) and the Australian Privacy Principles very seriously and is committed to handling the personal information we collect in accordance with our privacy policy and the requirements of the Act.
11.2 By registering to participate in the Learn to Earn Program, you agree that NumberWorks’nWords may exchange your personal information with service providers engaged to assist in facilitating the program.
12. Media
12.1 By participation in the Program, Participants consent to NumberWorks’nWords using the Participants’ names, locality, receipts redeemed in any media (including but not limited to TV, radio, website catalogue, press, email marketing, social media and point of sale) without compensation for the purposes of publicising and marketing the Program.
12.2 From time to time, a Participant may be requested to submit photographs to the Program Website in relation to the Participant’s involvement in the Program. Coordinators will ensure relevant consents have been obtained (including from the relevant school authorities) for NumberWorks’nWords to publish such photographs on the Program Website, and to use such photographs in any media (including but not limited to TV, radio, website catalogue, press, email marketing, social media and point of sale TV, radio, catalogue, press, and point of sale) without compensation for the purposes of publicising and marketing the Program.
